Inocentado de acusações, Daniel Cohenca mostra o real motivo de sua exoneração da Gerência do IBAMA de Santarém
6 de janeiro de 2010 por Fábio PenaNo mês passado, saiu a decisão final do presidente do IBAMA, inocentando o ex-gerente no processo que o acusava de irregularidades administrativas na sua gestão. Para a sociedade o caso havia ficado inconcluso, valendo então esta nota de esclarecimento.
Em novembro do ano de 2008, Daniel Cohenca foi exonerado do cargo de Gerente Executivo do IBAMA em Santarém, cargo que ocupava desde maio de 2007.
O IBAMA em si não mostrou oficialmente explicações sobre a exoneração, mas em entrevista a imprensa local o então superintendente do IBAMA no Pará, Aníbal Pessoa Picanço, atual secretário do estado de Meio Ambiente do Pará, expôs em entrevista que teria havido “crime”…“que afronta os princípios básicos que norteiam a Administração Pública que são a legalidade e moralidade”.
Através do memorando em anexo (AQUI ) o então superintendente mostrava ao presidente do IBAMA que a gerência de Santarém não estava seguindo a cartilha ditada pela governadora do estado Ana Júlia Carepa, e na sequência buscava desqualificar o gerente com a acusação leviana e, ao que veremos infundada, de que “alguns servidores e setores da Gerência de Santarém teriam sido pressionados pelo gerente para firmar contrato de R$ 45.000,00”. Culminava o memorando “solicitando a imediata exoneração ou afastamento” de Cohenca.
Com tal acusação o presidente do IBAMA, Roberto Messias exonerou-o do cargo em comissão.
As forças políticas e a imprensa santarena ficaram imediatamente divididas, pois os que conheciam o trabalho que Cohenca vinha desenvolvendo sabiam que havia muitos interesses em retirá-lo deste cargo, e que a acusação de corrupção poderia ser mero pretexto para desqualificá-lo e assim desqualificar inclusive o combate a ilegalidade ambiental.
Cohenca passou por um processo administrativo disciplinar, instaurado pelo presidente do IBAMA onde figurava como único acusado de improbidade administrativa. No entanto, após meses de investigação e interrogatório por uma comissão, todos os sete servidores que assinaram a transação financeira foram unânimes em afirmar que não só nunca receberam ordens de Cohenca para tal ato mas que nem ao menos haviam conversado com ele sobre a transação.
O relatório da comissão (anexo) conclui pela “absolvição antecipada do denunciado” e “o arquivamento do Processo”, ainda conclui que o ato de compra antecipada de combustível deu-se por iniciativa de outros servidores, mesmo assim com “a inexistência de má-fé”, e ainda que “agiram buscando o melhor para a administração pública, sem proveito próprio”.
O relatório transparece a falha no sistema público de licitações anuais que deixava o IBAMA sem o item mais básico para seu funcionamento, o combustível, durante o primeiro semestre de cada ano. Para evitar essa situação, antigos servidores administrativos anualmente praticavam compra antecipada no final do ano pelo bem da continuidade das atividades do órgão.
O Gerente executivo, como era de praxe, autorizou o pagamento das notas fiscais que chegaram a ele nos trâmites normais, devidamente recebidas e encaminhadas pelos setores responsáveis, sem nenhum indício de que se tratava de compra antecipada.
O despacho da coordenadora de processos disciplinares, acatado pela chefe da Procuradoria Federal Especializada e pelo Presidente do IBAMA cita:
“Da análise dos autos, verifica-se que após a fase instrutória ficou provado que as acusações eram improcedentes, inconseqüentes e viciosas e que a comissão processante concluiu pelo não indiciamento do servidor acusado, uma vez que, avaliados todos os elementos trazidos
aos autos naquela fase, tais como, depoimentos e diligências o trio processante chegou a conclusão de que os fatos apontados não constituíam ilícitos administrativos, não sendo comprovada a prática dos fatos imputados ao acusado.”
Num caso desse, como no caso de qualquer denúncia sem provas, anônima (como diz o memorando do superintendente), caberia uma primeira investigação, chamada sindicância. E não a solicitação da “imediata exoneração ou afastamento”.
As acusações e a exoneração do gerente em novembro de 2008 geraram uma instabilidade no IBAMA. Um a um os caminhões apreendidos em operações foram sendo liberados, as empresas lacradas foram desbloqueadas e a própria gerência do IBAMA de Santarém foi perdendo a força política e a autonomia financeira, obviamente trazendo prejuízos à proteção do meio ambiente.
Então quais os reais motivos que em setembro de 2008 levaram o então superintendente Anibal Picanço a tão veementemente buscar acusar Daniel Cohenca e divulgar as acusações pela imprensa ao invés de promover uma justa e limpa investigação prévia?
Era sabido que o IBAMA de Santarém vinha atrapalhando os interesses políticos da Governadora do Pará Ana Júlia Carepa. A fiscalização era incisiva, principalmente contra o desmatamento ilegal e as madeireiras cheias de irregularidades, num estado que desde 2006 é o recordista em desmatamento no Brasil, e que aumentou sua taxa anual no último ano (PRODES/INPE).
O ano de 2008 foi o ano das eleições municipais mais disputadas no oeste paraense. É bastante óbvio o quanto a ilegalidade ambiental financiava as campanhas eleitorais municipais no oeste paraense.
Enquanto o IBAMA em Santarém, apoiado e seguindo diretrizes da Diretoria de Proteção Ambiental do IBAMA de Brasília agia contra o tráfico de madeira ilegal e o tráfico de créditos madeireiros frios, facilitado pelos falhos sistemas de controle de fluxo madeireiro instituídos pelo governo no estado (Sisflora e Ceprof), o partido da governadora Ana Júlia apoiava-se nos madeireiros do Oeste do Pará buscando obter vitória eleitoral na maioria dos municípios. Em alguns municípios os candidatos a prefeito pelo PT eram eles mesmos grandes
madeireiros.
Em Santarém, Cohenca participou da discussão sobre a destinação das terras públicas das glebas Nova Olinda e Mamurú. Defendeu a criação de unidades de conservação buscando a preservação de áreas que o governo do estado cedeu para madeireiros a título de “permutas” de terras e “ADIPs” (autorizações de detenção de imóvel público). O governo do estado se pronunciou em defesa do direito dos madeireiros, manifestando-se contrários a criação de unidade de conservação na área e hoje se vê o conflito (inclusive com incêndio em balsa) entre as populações tradicionais, antigos ocupantes da região, e madeireiros apoiados e autorizados pelo Governo do Estado.
No município de Prainha o Governo do Estado insistia em manter ativas algumas destas ADIPs que exploravam madeira em área muito além do que o seu manejo autorizava ao tempo que emperrava a criação da RESEX Renascer. O IBAMA buscou suspender as atividades da empresa, porém que só poderia ser definitivamente suspensas por força do cancelamento das ADIPs e da licença de operação, o que o governo do estado recusou-se a proceder. Quando finalmente a RESEX Renascer foi criada, devido a negociações do governo do Pará ela tinha metade do tamanho originalmente previsto para a reserva. Não abrangendo as áreas de interesse madeireiro.
Em 2008 técnicos do IBAMA em Santarém flagram que nos cadastros da SEMA existem 93 serrarias operando dentro de unidades de conservação, terras indígenas, áreas militares e assentamentos do INCRA, todas com licença ambiental válida, em atividade e com cadastro no CEPROF e SISFLORA. O IBAMA solicita a suspensão imediata das empresas e a fiscalização em loco.
Está evidente que o Meio Ambiente é para o PT do Pará a moeda de troca mais barata para as eleições, e o IBAMA de Santarém, mesmo com suas conhecidas limitações em termos de pessoal e equipamento, foi descobrindo tais irregularidades e se mantendo irredutível em suas
funções sócio-ambientais. Os empecilhos às aspirações políticas da Governadora Ana Júlia Carepa, foram os motivadores dos pedidos de exoneração de Cohenca emanados da Superintendência do IBAMA em Belém, sabidamente dominadas pela governadora e pelo ex-superintendente Marcílio de Abreu Monteiro (ex-marido da governadora e atual secretário de estado de Projetos Estratégicos). Em junho de 2009 Aníbal Picanço torna-se Secretário de Estado de Meio Ambiente e no primeiro mês de gestão autoriza a exploração de 544 mil metros cúbicos de madeira, cinco vezes mais do que seu antecessor Valmir Ortega autorizou nos seis meses anteriores. Aliás, Valmir Ortega foi exonerado também com denúncias infundadas de corrupção. Parece que a fórmula deu certo, retira-se o incômodo acuado por denúncias que
demoram a se mostrarem inverídicas e ele fica quieto, sem voz para denunciar.
E esta é somente parte das conexões milionárias da madeira ilegal no estado do Pará.

I don’t know whether it’s just me or if everyone else encountering
problems with your site. It looks like some of
the text on your content are running off the screen.
Can someone else please provide feedback and let me know if this is
