Campanha apresenta carta no I Fórum da Internet no Brasil

Várias entidades participantes da Campanha Banda Larga é um direito seu! participaram do I Fórum da Internet no Brasil, realizado nos dias 13 e 14 de outubro, em São Paulo, por iniciativa do Comitê Gestor da Internet no Brasil.
As organizações presentes escreveram uma carta com suas principais reivindicações no campo da conectividade. A carta foi lida na plenária final por Adriane Gama, do Coletivo Puraqué, e Renata Mielli, do Centro de Estudos da Mídia Alternativa ‘Barão de Itararé’.
A urgência de tratar a banda larga como direito da cidadania
A iniciativa do Comitê Gestor da Internet de realizar este I Fórum da Internet no Brasil é um importante marco por ampliar o envolvimento direto dos cidadãos e cidadãs na reflexão dos temas críticos que afetam a expansão e dinâmica de funcionamento da Internet no país. Sua primeira edição conseguiu garantir a diversidade regional e a representação dos diversos setores envolvidos no tema, preservando uma das principais características do CGI.br – sua composição multisetorial –, que o torna referência mundial para a governança da Internet. Antes mesmo do encerramento do Fórum, já é possível manifestar a expectativa de que ele se torne um evento anual.
A realização deste I Fórum acontece em um momento político importante para a banda larga no país. Desde o início do ano, uma série de ações vêm sendo implementadas pelo Governo Federal, em especial pelo Ministério das Comunicações e Anatel, no sentido de ampliar o acesso à Internet. Neste momento, está em pauta a definição de parâmetros de qualidade para os serviços fixo e móvel, que devem ser aprovados até o final de outubro pela Anatel.
Todas essas ações são de fato um avanço em relação à crítica ausência de políticas públicas prevalente até 2010. Contudo, as entidades que fazem parte da Campanha Banda Larga é um direito seu! entendem que as medidas são absolutamente insuficientes para promover a universalização do acesso à banda larga no Brasil. Mais do que isso, veem com bastante preocupação o fato de a universalização não ser posta sequer como um objetivo nas medidas regulatórias e políticas públicas.
É importante lembrar que na I Conferência Nacional de Comunicação, realizada em 2009, os diversos segmentos presentes aprovaram por consenso que o acesso à Internet deveria ser definido como direito fundamental e que o serviço deveria ser prestado em regime público, o que garantiria metas de universalização e controle de tarifas. Nenhuma dessas duas perspectivas está contemplada nas atuais políticas públicas.
O diagnóstico da Internet no Brasil é dramático. O serviço hoje é caro, lento e para poucos, com penetração residencial de apenas 27%. São especialmente preocupantes as disparidades regionais. Na região Norte, especialmente, o acesso é totalmente restrito, com baixa velocidade e qualidade e com preços exorbitantes. Iniciativas estaduais que poderiam ajudar a mudar esse quadro, como o NavegaPará, retrocederam na qualidade e têm sido relegadas a segundo plano. A falta de competição cria monopólios locais e dificulta ainda mais o desenvolvimento do setor.
Para completar, o cenário de crise econômica gerou cortes em áreas críticas, como as políticas de inclusão digital e o financiamento da Telebrás. Na contramão desses cortes, estão sendo definidas medidas de incentivo fiscal para as empresas de telecomunicações construírem redes privadas. Essas medidas contrariam a proposta inicial de fortalecer a Telebrás para cumprir papel estratégico na regulação e indução da competição.
Frente a esse quadro, entendemos que há cinco ações fundamentais a serem tomadas no curto prazo:
- Definição de parâmetros de qualidade – a Anatel deve aprovar parâmetros de qualidade que garantam velocidade e índices de qualidade de rede que sigam, no mínimo, as propostas previstas na consulta pública nº 46, e que considerem também a relação da rede da operadora com outras redes, garantindo instrumentos para que o próprio consumidor faça o monitoramento desses parâmetros;
- Migração para o regime misto (público e privado) – deve ser planejada a migração do serviço de banda larga para o regime misto (público e privado), de forma a garantir a universalização do serviço e o controle de tarifas, preservadas condições especiais para os pequenos provedores;
- Retomada dos investimentos no programa Telecentros.br – deve ser retomado o investimento nas ações da rede de formação e na entrega de equipamentos e conexão, com a definição de obrigações de atendimento gratuito aos telecentros pelas empresas de telecomunicações.
- Aprovação do Plano Geral de Metas de Competição – aprovação de instrumentos de indução de competição com diretrizes específicas para as redes públicas que estão sob gestão das concessionárias.
- Recompor o papel da Telebrás no Plano Nacional de Banda Larga
Essas ações no campo da conectividade se somam àquelas necessárias a garantir a liberdade e a neutralidade na rede, como a aprovação do marco civil da Internet e o impedimento de aprovação de leis que afetem esses princípios, como o PL 84/99 (AI-5 Digital) e o PL 1.481/07 (que modifica a lei do FUST).
Neste momento, nos parece fundamental garantir que a universalização do serviço de banda larga seja prioridade das ações do Governo Federal, como apontado pela Presidenta Dilma, com o fortalecimento do papel do Estado como indutor do desenvolvimento social e econômico. Só assim acreditamos que será possível garantir uma banda larga barata, de qualidade, para todos, e uma Internet de fato democrática e inclusiva.
